This new version of the report « February 7, 2021: End of the Presidential Constitutional Mandate » particularly reinforces the analysis the legal precedent, taking into account the end of the 50th legislature (January 2016-January 2020) and the mandate of two thirds of the Senate (20 senators) on the 2nd Monday of January 2020, although some deputies and senators took office in 2017.
It complements CARDH’s thematic report that provides a legal analysis on the length of the constitutional presidential term of office, which shows that the five years of the presidential mandate, Article 134-1 of the Constitution, are not calendar, i.e. cumulative regardless of the beginning of the term, but constitutional, meaning that they fall within the timeframes clearly defined by the Constitution: February 7, 2016 to February 7, 2021, February 7, 2021 to February 7, 2026, and can in no way be adjourned or extended.
